    One word answer:

    Y2K

So AC21 and visa recapture happened without anyone trying for it.

They increased quota of H1B, did AC21 because it was a market demand.
Now the economy is down, there are elections, jobless rate is high............ so think why will they increase h1B quota or greencard quota? What is the incentive for government?

I have always held that asking for quota increase is a bad idea and will not happen.

Visa recapture is the best bet and even that appears to be a hassle as there are many factions opposing it.

I am confused about receipt date?

Notice date is when the receipt notice is generated- That's simple

Is receipt date the date when they do data entry into the system or is it the date when they receive the package even though they may do data entry a month later?

In other words people who filed there application on July 2nd,3rd etc ... and lets say USCIS takes 2 months to receipt those cases.. then after 2 months when the notice is generated won't it have a July 2nd receipt date? for July 2 filers?

    Hi Lonedesi,

Thank you for your response. Are you saying that we can take a chance by just sending the letter which includes details such as A#, receipt numbers etc; without completed DHS Form 7001. This sounds to be good plan, where employer is not supporting. However., the only catch is, if employer knows about this later, it doesn't look good.

Please correct me , if I'm wrong about understanding yout statement.

    Thanks again!

Look at this post. The thoughts are compelling. Is this something that we should get some clarifications on?

This is what trolls have done in the past. When ever we have had a successful event. Trolls from anti-immigration groups, demand disclosure of financial statements and raise doubts on IV leadership. Don't get drawn into this. Lets keep doing what we are.

You morons, You have spent so much time in useless discussions and anti-immigrants are laughing at your foolishness. Its high time your greencards applications get a denial or RFE. You will come crying to IV to save your status. Or else you will be deported. That is all you can do. You guys have got sub labor or faked your resumes and now you want someone to be accountable to you. First learn to be accountable to yourself and your values.
Here is what antis are telling you aholes:
As for you fuckers over at Immigration Voice that caused this temporary outage, keep it up. The more time you waste harassing me, the less time you have to send flowers to politicians, begging for your green cards.

Give it up, slumdogs. The whole H-1B thing was like a little tryout to see if you scumbags could fit into American society. Since it is clear that the bigoted, misogynistic caste mentality is ingrained in your DNA, we have to send you home. Maybe we will make you wither in limbo for 10-20 years, dangling a green card in front of your eyes, but the end result will be the same. You will have to leave.

Unfortunately some of you may not live long enough to see that open sewer of a sub-continent again. You may die here in America, in an accident, or by natural causes, or commit suicide like all the techies in India are doing.

Either way, by death or deportation, you will be gone.

And Americans can go back into I.T. once again and reclaim the industry that we created.

    STFU you freeloaders

A lot of people had applied in EB3 since EB3 was current for a fairly long time and their lawyers suggested them to do so to avoid additional documentation. Many of these people could have applied in EB2 as they had the required qualification including me (US masters). Just like you could have applied in EB1 since you have a Ph.D; but you decided to apply in EB2.

The catagory on which a person applies for greencard doesn't necessarily reflect his/her capability or intelligence. After all, if Michael Dell or Bill Gates had to apply for green card they had to apply in EB3. On the other hand, a lot of EB2 filers just fabricated their resumes with years of experience to qualify for EB2. But that shouldn't overcast shadows on real EB2 peoples ability.

I don't know from where you got your Ph.D but it definitely didn't inprove your ability to think rationally as evident in your post.

are bhagwan... kash maine substitue labor use kiya hota....

I would have been approved by then...

Been here since 1996 and have a doctorate .. but still in EB2.. and i don't regret it .... but i don't want anymore line jumping for sure.

    Please help me understand this:

The Dept. of State's web site has the visa bulletin for SEpt 2008 as:

    EB INDIA
    --------------------
    1st C
    2nd 01AUG06
    3rd U

And the US Consulate's web site at Mumbai has:

    EB INDIA
    ------------
    E1 Current
    E2 1 April 2003

So, how come Consulates got the latest information? Why not post this on the DOS page too by the DOS?

I am so sick and tired of this whole process of GC. I am starting to question myself if this entire process of wait, is worth at all? If you are illegal, you are free in this country, if you are legal they scrutiny your papers with a microscope....I am sick, totally sick. There is a limit to patience, too.:mad::mad:

    Hi All:

Appreciate all the groundwork you have done so far with reference to sending out mail.

I am based out of DC Metro area and would like to initiate / participate in meeting the lawmakers about the EB3 Issue and bringing it to their attention.

We need to do something about it NOW.

I am willing to take off from work and meet with whoever concerned would make a difference.

Senior Members we need your inputs.

    Thanks,
    K

...let your Nor Cal members know - I'm trying to prepare a comprehensive document with lessons learned from the San Jose rally. Sort of a post mortem "what went right, what went wrong, how to improve" thing. It may take a few days, as we are all recovering and catching up!

Feel free to pm or email if you need anything or have questions.

I don't want to sound like a know-it-all, but we are more than willing to help out however we can.

Drona, from SoCal, was up for the rally and integral in helping out as well.

You need to change the SUBJECT also...

    /***
FBI fingerprint bumping and checks are IGNORED for IMMIGRANTS - Can not believe it ? This is called HOMELAND SECURITY ???

How come USCIS / DOS can ignore CRITICAL FBI name check steps ?
    ***/

What the hell on earth is this? Do you know for sure they have ignored it? Do not add masala to the existing crap. Do you understand the consequences of these kind of spiced up stuff? We all would be sulking in the security check for ever, if DHS gets pissed off or gets a congressional hearing and the authorities get lambasted over this. You are seeing how doctors are being implicated in UK and all over. Security is the most important thing right now on this planet and western world is agog over security. I dont know from where Greg Siskind and Jay Solomon got the tip off. They tipped each of their hats off and put the story in our brains to run the show. Security is not a Joke. Do not make it a bigger issue unless you dont know whether it really has happened. The consequences can be pretty dangerous to the extent of revoking all the issued GC's in the past 20 days, if congress gets high on this. I dont know what lawyers want, but my understanding is none of us want to have negative consequences of this issue.

No matter who screwed up, we should be conveying the following message after we say that USCIS/DOS goofed up.

"The root cause of the situation is the inability of
    a) DOS/USCIS to recapture the visa numbers from previous years
    b) to carry forward the unused numbers for atleast one year

If congress makes the needed legislative changes to solve the above two issues, USCIS/DOS will not be in the ugliest predicaments like they are in right now"

Its our choice to make USCIS/DOS our enemies or we get compassionate to the situation considering how arcane the current laws are. We agree or not, we have to work with them going forward. Just that they are down and we are on a bashing spree right now doesnt mean that it will be situation for ever.

I dont have any opinions on the main topic here - just wanted to chime in on this one...
Many CEOs work for $1 a year - thats just the salary component and only one side of the story. There is another side to it - stocks and options. No one gives up the stocks that they keep getting every year..infact, for many of these guys, the salary is just a drop in the bucket. Their real cash cow is the hundreds of thousands in stocks that they receive each year. Nobody gives those up. The $1 per year is mostly a publicity thing...

So this actually supports my point. There is no "loophole" to close.

I recommend my friends snathan and swissgear to avoid actions based on jealousy over people just like yourself. But hurting them you hurt yourself

Giving reds - is that the only thing you can do? Do you want more "helpful" posts from me? I wish to avoid the specifics of your arguments or rebukes, as they are not important here, so if my replies are not "helpful" then perhaps your arguments are irrelevant to begin with
