Hi,
I wanted to know if we can transfer an approved H1 while on OPT?

For ex Company A applies for my H1 and gets approved in May 2007 although it applies fromOct 2007. Now i get an offer from Company B before Oct 2007 say in July 2007. Can i transfer my H1 even though it starts from Oct 2007?

Opponents of health care reform efforts have accused the President and Democrats in Congress of including millions of illegally present immigrants in proposals to expand health insurance coverage. Whether one thinks that including such individuals is good or bad, the fact is that only lawfully present immigrants will be eligible for inclusion in the various proposals being considered in Congress. Think Progress explains in a piece refuting erroneous reporting on Lou Dobbs show (surprised?). When you hear figures like 97% of people will be covered under the broadest plans, the 3% they're talking about leaving out are undocumented immigrants.

My friend H1B is expiring this month end but she has valid EAD wth her.When we are planning to use EAD from H1B,what is the procedure for that?Do we have to send any forms to INS for this change of status??

Just you need to fillout a new I-9 form and hand over it (along with copy of EAD) to your H1B employer ,also mention moving to EAD..thats it..

I have an I-485 filed under EB2 category and have used the Advance Parole documents to travel outside US. As a result my I-94 states my status as "PAROLEE".

I recently got my EB1-I-140 (Extraordinary Ability) approved and my lawyer wanted me to apply for a new I-485 saying that transferring a I-485 gets rejected more often.

However, on knowing that my I-94 states that I am a Parolee she tells me that she cannot apply for a new I-485. Is that true?

Urgent response will be greatly appreciated.

Folks,

I have a coworker who is a citizen of Canada and got I-140 approved yesterday.

The question is how safe, easy and hassle-free it will be to do a CP (Counselor Processing) from Canada instead of I-485? CP will be done in US embassy in Montreal. Do you guys know any experiences from your other friends? Any relevant information will be appreciated.

One of the bigger myths floating around regarding DREAM is that it will lead to chain migration. The thought is that DREAMers will get citizenship and then quickly sponsor their parents for green cards. Not quite. DREAM Act recipients must wait ten years in a non-immigrant conditional status to apply for a green card. I am on H1B visa, and now I am going to fly back to my home country. Unfortunately, I can't find the original left lower portion of my I797, which is "for personal record". I still have the orignial upper portion, I94, and copies of the whole I797 form.

Will I have trouble getting my visa stamp and reenterring this country? What should I do now?

I count myself as one of the lucky ones as I already have a GC for the last two years and enjoy working in the US. However, my company has offered me a position in Europe for three years and I was wondering how this would affect my green card status. Can I put it on "hold"? If so, is it easy. Any feedback would be appreciated.
