Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

I have H 1B VISA but never went to USA....
1) now if i want to go there... will there be any problem

Does anyone know or have experience for visa stamping in Canada. My wife needs to get F1 stamp. She came to USA on H4 visa, applied for F1 status. It got approved and now I want to get F1 stamp.

Hi All,
My wife has her h4 visa stamping in a week's time. I have sent her all the documents required.
My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??

Hello,
My wife changed her status from H4 to F-1 while in USA. Now due to family situation, she wants to travel to India. She is on OPT now and working for an IT company since Apr 10.
She will be going for her first F-1 stamping. I know it is risky to go for F-1 stamping while on OPT.
a) What are her chances of get F-1 stamping?
b) What measures should we take that will increase her chances ?
If any body had similar expeince please share here.
Attorneys or any one please guide us in this regard.

Please let me know how do I convert TR labor pending in BEC to RIR.
Accoding to recent law, I know that we can do it
My original application was filed under RIR and my RIR has been rejected and my LC went back to TR queue. I also know that you can again convert back to RIR from TR even if original RIR is rejected.Blood $uckers took 4 years to tell this.

I was in confusing situation,hope you can clarify and help me out.
My wife came to US as H4 in Feb 08.Her i-94 is valid till march 2010.
She applied H1 got H1 approved from Oct08 for 3 years.Since from Oct08 , employer couldnot find project for her.Her employer is asking to move from H1 to H4 back using Cos(i-539).After getting project can move back from H4 to H1 which doesnot come under quota.
My questions are:
1.Is it safe to move from H1 to H4 and back to H1 when she gets project.
2.Her previous H4 i-94 is valid till March 2010.She didnot went to india again.
If she converts from H1 to H4 now,till when she will get i-94(till my H1 valid or original i-94 date).
If she gets i-94 till original i-94 i.e March 2010,does she needs to go to stamping after March 2010 again or continue to be in US even after March or just go for border and get new i-94.
Can you please clarify.

Hello,
I have a RFE for my 485 according to the online status. My PD is current, and NSC's 485 processing time is now July 19, 07. My 485 RD was July 25, 07, so it is likely that they are working on adjudicating my case (and could have approved if there were no RFE).
I am still waiting for the RFE in the mail to know what it is exactly. But, assume that I fulfill their request and mail them the required items immediately, will I need to wait another 6 months before they check my RFE fulfillment? Or do they usually look at the RFE immediately (since they are already working on my case)...

My wife's H1B got approved earlier this week through company A. Company B also made an offer last month but they are still working on the H1B visa issue with the attorney.
So, my question is if this company (B) files H1B now, then it should be a "transfer (not subject to quota)" or "new petition (subject to quota)"?
I think she is already on H1B as of today with COS effective immediately approval so any new employer can only apply for transfer and they don't need to ask for COS. We will not have pay-stubs to transfer as we are still to receive the I-797 copy and apply for SSN so that payroll can be run for her.
Please let me know if anybody has got any insight on this situation. Very much appreciate your time.
