USCIS has announced that for the third week in a row, the H-1B count sits at 45,000 out of 65,000 used. Lawful permanent residents (LPR) of the United States (green card holders) need to keep their trips abroad to a relatively short period of time. The Department of Homeland Security (DHS) could determine that an LPR has abandoned their residence if the LPR’s intent was not to return to the U.S. within a relatively short period of time.
Factors DHS could consider in evaluating the LPR’s intent include:
Whether the trip abroad is lengthy or for a short period of time;
LPR’s family ties in the U.S.;
property holding in the U.S.;
business affiliations within the U.S.;
LPR’s family, property, and business ties in the foreign country.

Hi all,
My PERM labour certification was filed on 25th oct 2006, my case was selected for random audit on dec 06. My attorney replied with all the evidence for the audit. After reviewing the case CO at dol denied my case on Feb 07.
My attorney has asked my case to be reconsidered/reopen on March 2007 as they are confident that they have supplied all the documents required for the case. My attorney says it will take 6-8 months for DOL reopen the case and judicate the same which is Nov 07. what is best option i have as all the dates are current now? i have discussed with my attorney they have told me clearly they are not going to reapply as its a very big company and it will take lot of time for me to get clearance to file my perm again.
Does anybody having experience like my case can share your views it will be really helpful.

I need an advice.
Last year, I petitioned for my husband to get his green card and I was in a rush to get the application in before the application fee shot up, so I forgot to make copies of all the documents being sent to USCIS. Now, the interview is next week and I don't have a few of the documents that they want us to bring. It says that if already submitted, I don't have to bring in those documents, but I've heard that sometimes the interviewers still demands them during the interview.
Is there any way of getting the documents from USCIS or is it lost forever?
We will have the interview next Thursday, 21st of February.

My wife who is a derivative applicant for the GC is employed on EAD. She has been advised to go on a pregnancy short term disability leave by the doctor. We live in California and her company provides the short term disability through the California SDI.
Is it ok to claim this while having applied for GC. Is the SDI by any chance considered a public charge? Any help would be appreciated.

1) Wrap up the backlog and introduce enough visas to make all categories EB2/EB3 current for everyone.
2) Eliminate this nonsense of H1 visa stamp. A person should be able to apply for visa while remaining in the US.

Hello All,
Being on H-1 never allowed you to get promoted unless the employer did all the necessary paperwork with USCIS/DOL. EAD being work authorization not limited to current employer, can EAD mean a little more freedom to waiting-for-GC H-1Bs in terms of being able to get promoted within the organization, get different job titles, etc ?
Also, I have 140 approved and H-1B ext was granted for 3 years (till 2010). Does it make any sense to apply for EAD alongwith 485 ? If EAD gives the career advancement opportunities, can I apply for it but keep using my H-1B to re-enter US till 2010 if needed ?

You may be able to stay without a job as long as the future job offer is still open and the gc sponsoring employer has an intent to hire you after the 485 is approved. Please confirm with your immig attny

just talked to an IO at Nebraska and was told that my file is waiting for an officer to look at.
When I asked how long will it be before they get to it, she says they have like 500 cases each but that I should be hearing something soon?
Any ideas ...how soon ? Has anyone else had a similar conversation and how long did it take before they heard something??
I know there is nothing definate...but just wanting to share and hear back if anyone had similar experience.
