    Two weeks ago, I went to Infopass appointment and Immigration officer said they scheduled my fingerprinting next week and will get the notice in mail. This fingerprinting was due long time so they scheduled one now.

    IO asked me whether the date and time is ok for me and I said yes i.e. next friday.

    But so far I havent received any notice regarding this.

    What to do now? any one had this problem, please share your experience....

    I'm working on L1 & have H1 petition without COS.

    Can my H1 employer apply for COS, so that I can change my status from L1 to H1 without visiting India?

    Also, I've an offer from a third company... can this company file for Change of Status from L1 to H1 & transfer the H1? I've the H1 petition I129 number, but no paystubs on H1. I've paystubs on L1.

    Can I transfer to H1 to this third company? Will I have to get my H1 stamped frmo INdia then join this third company?

    If not, is there any other option?

    Please reply. Help appreciated.

    When Senate Majority Leader Harry Reid picked up his ball and went home after his staged all-night session last week, he saved from possible embarrassment one of the least regular members of his Democratic caucus: Sen. Ben Nelson of Nebraska. Reform Republican Tom Coburn had ready an amendment to the defense authorization bill removing Nelson's earmark funding a Nebraska-based company whose officials include Nelson's son. Such an effort became impossible when Reid pulled the bill.

    That Reid's action had this effect was mere coincidence. He knew that Sen. Carl Levin's amendment to the defense bill mandating a troop withdrawal from Iraq would fall short of the 60 votes needed to cut off debate, and Reid planned from the start to pull the bill after the all-night session, designed to satisfy antiwar zealots, was completed. But Reid is also working behind the scenes with House Speaker Nancy Pelosi to undermine earmark transparency and prevent open debate on spending proposals such as Nelson's.

    These antics fit the continuing decline of the Senate, including an unwritten rules change requiring 60 votes to pass any meaningful bill. When I arrived on Capitol Hill 50 years ago, Majority Leader Lyndon Johnson (like Reid today) had a slim Democratic majority and faced a Republican president, but he was not burdened with the 60-vote rule. While Johnson did use chicanery, Reid resorts to brute force that shatters the Senate's facade of civilized discourse. Reid is plotting to strip anti-earmark transparency from the final version of ethics legislation passed by the Senate and House, with tacit support from Republican senators and the GOP leadership.

    At stake is the fate of Coburn's "Reid amendment," previously passed by the Senate and so called because it would bar earmarks benefiting a senator's family members such as Reid's four lobbyist sons and son-in-law. Nelson's current $7.5 million earmark for software helps 21st Century Systems Inc. (21CSI), which employs the senator's son, Patrick Nelson, as its marketing director. The company gets 80 percent of its funds from federal grants, mostly through earmarks. With nine offices scattered among states represented by appropriators in Congress, the company has in recent years spent $1.1 million to lobby Congress and $160,000 in congressional campaign contributions. "As of April," the Omaha World-Herald reported, "only one piece of [the company's] software has been used -- to help guard a single Marine camp in Iraq -- and it was no longer in use."

    In requesting the 21CSI earmark, Nelson did not disclose his son's employment. "There's no requirement that he disclose that," a Nelson spokesman told this column. "But frankly, in this case, we didn't disclose it because it's so public." An April 24 letter from Levin giving senators instructions on how to request an earmark made no mention of the "Reid amendment" that had been passed by the Senate three months earlier but that required only certification that no senator's spouse would benefit from an earmark. Inclusion of Nelson's son, however, would be required if the ethics bill provision passes.

    When the defense authorization bill came up last week, Coburn prepared amendments to eliminate the Nelson earmark and the most notorious earmark pending in Congress: Democratic Rep. John Murtha's proposed $23 million for the National Drug Intelligence Center in his Pennsylvania district. Reid's plan to satisfy antiwar activists with an all-night debate averted debate, for now, on those two earmarks.

    Reid, the soft-spoken trial lawyer from Searchlight, Nev., has tended to suppress free expression in the World's Greatest Deliberative Body in his tumultuous 6 1/2 months as majority leader. Last week, he cut off an attempt by Sen. Arlen Specter, the veteran moderate Republican, to respond to him with an abruptness that I had not witnessed in a half-century of Senate watching. When Specter finally got the floor, he declared: "Nothing is done here until the majority leader decides to exercise his power to keep the Senate in all night on a meaningless, insulting session. . . . Last night's performance made us the laughingstock of the world." It may get worse if plans to eviscerate ethics legislation are pursued.

    of 65 percent, though performance declined from the prior years. PERM performance was
    affected by the reallocation of resources to eliminate an applications backlog in the H-2B
    Temporary Non-agricultural Program. In FY 2008, the DOL will closely monitor
    implementation of the Fraud Rule for impact upon PERM processing and redirect resources that
    were used to eliminate the H-2B backlog to the PERM program as needed. Keeping these
    factors in mind, the target for PERM application processing within six months will be 76% by
    FY 2009.

    I am July 2nd filer at NSC.
    I got my EAD approved from NSC on 25th. I see a message-- card ordered. Today there is one LUD , approval notice sent.

    Is this common

    Hi Friends,

    I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.

    1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.

    2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?

    3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.

    It'll really helpful to decide based on the folks replies. Thanks alot for the help.

    Against the prevailing dismay over partisanship and dysfunction in the U.S. Senate, consider the testimony of one happy senator.

    Ben Cardin, freshman Democrat of Maryland, says he has been surprised since his election almost a year ago at how possible it is to make progress in the Senate. It is easier to form bipartisan alliances than it was in the House, he says. Senators who strike deals stick to them and will not be pulled away by pressure from party leaders. And, even despite the 60-vote barrier, real legislative accomplishments are within reach.

    Cardin is part of an impressive Senate class of nine Democratic rookies (including Bernie Sanders, an independent who caucuses with the Democrats), others of whom have gotten more attention than he has during their first year. Virginia's Jim Webb, to name one, has proved more compelling to the national party and media, with his military past, literary achievements and quotable economic populism.

    Consider, by contrast, the first sentence of the " About Ben" biography on Cardin's official Web site: "Benjamin L. Cardin has been a national leader on health care, retirement security and fiscal issues since coming to Congress in 1987." No wonder the Democrats chose Webb to respond to President Bush's State of the Union address in January.

    No one would accuse Cardin of putting charisma over substance. A legislator's legislator, he served in the Maryland House of Delegates for 20 years, as speaker from 1979 to 1986, and then represented a part of Baltimore and surrounding suburbs in the House of Representatives for 20 more. Now he's delightedly burrowing into the Senate.

    During a visit to The Post last week, he ticked off a series of what he called medium-level issues on which he believes something can be achieved: providing incentives for good teachers to work in the neediest schools, getting the Army Corps of Engineers involved in Chesapeake Bay cleanup, establishing a commission to chart a path to energy independence within 10 years and reauthorizing (for the first time in decades) the federal program that provides lawyers for those who can't afford them.

    Cardin acknowledged that prospects for progress on the biggest issues are dimmer, but even there he's not discouraged. "Social Security is easy to solve," he says, and achieving energy independence within 10 years is quite doable; both just require more leadership from the White House, which he hopes a new (Democratic) president will provide. He's signed on to the Lieberman-Warner bill on climate change and thinks it could get 60 votes, too, with a little prodding from on high.

    The failure of comprehensive immigration reform, he grants, was "an embarrassment." Senators were not prepared for the force and single-mindedness of the opposition to what was perceived as amnesty for illegal immigrants.

    "It is an explosive issue," Cardin said. "It crippled our office's ability to get anything else done." The letters he received were well written, not part of an organized campaign, from all corners of the state -- and unequivocal. "They said, 'This is not America. America is the rule of law. How can you let people sneak into the country? If you vote for this, I'll never vote for you again' " -- an argument that tends to seize a politician's attention.

    Cardin did not and still does not believe that the bill provided amnesty. It insisted that illegal immigrants atone in a number of ways, including anteing up back taxes, learning English and paying a fine. "If you go much further, people aren't going to come forward" and out of the shadows, he says. "I don't think it makes a lot of sense to be sending troops after them."

    But even here, he has faith that the Senate eventually can pass immigration reform. It was a mistake to craft the bill in closed meetings, he said; next time, open debate would create less anxiety. Reform advocates have to communicate better what requirements they're imposing in exchange for legalization. But ultimately, "you can't hide from what needs to be done. You have to deal with the 12 million, with border security and with the fairness issue" for immigrants and would-be immigrants who have played by the rules.

    Cardin is not naive about the political obstacles to progress. But unusually for Washington, he seems less focused on blaming the other side for gridlock than on avoiding gridlock in the first place.

    "Quite frankly, the solution on immigration is easy, even if it won't be easy to accomplish," he says cheerfully. "You just have to get a bipartisan coalition and get it done."

    I am not sure if it was posted before, the immigrant visa fee will go up to $400 from $380 effective January 1, 2008.

    Also, Bombay and Madras consulates switched to NVC appointment processing (NVC takes over the scheduling of immigrant visa appointments). Delhi and Calcutta are still standard processing posts, but expect them to be converted in the near future as well.
    Chinese, Japanese, Australian and some other (mostly Asian) consulates still follow standard processing, but expect them to be converted in 2008 as well.

    They convert consulates without any notice to the public, so always check here before sending in DS-230 and supporting documents:

    My PD is 09/2002. I have already renewed EAD for 3 times. Still I have been using my H1, not on EAD. Due to lot of expenses, I don't want to renew EAD again. Current EAD is expiring in September. Is that okay? or better renew? Thanks.

    My I-140 & I-485 were filed concurrently in July and I have received the receipt notices last week. I have been told by my manager that I have been considered for a promotion. The job title changes from Sr.Database Administrator to Sr.Database Administrator,Staff. The new job after promotion will have additional/new responsibilities like leading/mentoring the team members in addition to the current job responsibilities. I have the following questions:
    (1) Is there any risk to GC processing if the job title changes ?
    (2) Is there anything that needs to be done/filed with USCIS to reflect the job title change ?

    Hi All ,
    I remember last time when PD became current USCIS did not follow the correct order /sequence of PD while allocating visa numbers .
    Many of the people who had PD of 2006 got Visa number allocation before people who were in queue ahead of them with 2004/2005 PD.

    This time we should have some campaign may be by sending the letter or some way to USCIS/DOS and make them aware to allocate visa based on PD in a fair and transparent way.Any suggestions ????

    This opportunity has come after many many years for many of us, we should make our best effort that visa number allocation are done in a fair and transparent way for coming month and month's to come.

    I Lost my I797A (but having photo copy) . I want to go to my Home country on emergency for 2 weeks and return to US.

    Will I get visa stamping with

    1. Copy of I797A and Employee's related documents ?
    2. Copy of I797A and Employee's related documents + Proof of Duplication Request ?
    3. Whether Duplication form (I-824) Should be separately filed for L1 & L2 ?

    I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.

    EB-485 processing times in NSC is FOUR (4) Months for the visa number available cases, and also pending EB-485 cases whose visa numbers are current and ready to adjudicate . So does this mean that cases with PD's not current but ready to adjudicate will get their I-485 approved by 6 months . Can some one please break it down for me .
