hi all,
I've found myself in abit of a predicament. My application for H1B extension is still pending (filed in September) and all I have right now is a Notice of Action from the immigration department.
While waiting, I have been laid off this week... I intend to return back to my home country before my last day (Dec 31).
My question is: Would I be able to make a round trip? That is to say, come back to the US on a tourist visa a week after I got home? I need to come back to sell what I own here and settle other things.
A friend told me that it is better to overstay for however long (maybe an extra week, I don't plan on too long) I need to get my things in order than try to take the chance of coming back. What do you think?
I appreciate any advice you can give.

Wadhwa projects that in the next five years, 100,000 immigrants will go back to India and 100,000 to China, countries that have had rapid economic growth.

Hi all,
I am an American and my wife is going though the green card application process. We recently received our interview date. Unfortunately, it was scheduled one day prior to our wedding ceremony which is out of the country. Our wedding is being presided over by the mayor of a fairly large city, with like 300 or so guests and at this point would be impossible to change. At the same time I hear that mixing international travel and rescheduling green card interviews is a risky thing.
We have an infopass scheduled in two weeks, and beyond the supporting documents of our flight and wedding information, is there anything else we should bring to prove that we can't possibly be at this interview? Is this something a lawyer might be able to handle better (like have more credibility)?
Anyone willing to give odds on us successfully changing our interview date?

Sen. Elizabeth Dole, sadly, was not given points for sizzle -- or much else, for that matter. She ranked as the 95th most powerful senator. Yes, that is out of 100. Vying for the bottom rung was also Sen. George Voinovich, who despite serving since 1998 ranked 90th. And as if he hasn't already had a bad year (or two), Rep. Hi
I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.
My question is where should I file my AP?. Do I need to file with NSC or TSC?.

With the current market crisis, you never know when you will be out of job.
Though I have my H1B valid till 2011( my I140 is approved and is already over more than six months, 485 is pending), Most of the people suggesting me to apply for EAD.
1) What are the procedures I have to maintain ( in connection to USCIS and my green card application pending) if I change employer?
2)Can I also work for multiple employers on EAD?

I am Canadian Citizen, born in India. My Father, USA Citizen filed I-130 for married son during FEB-2003 and approved. I am here in USA since 2006 working on TN, current status will expire in JAN-2013. Waiting for PD to current for my F-3 (Family), this month PD is 01JAN01.
Questions,
1. I can see now PD is moving fast, any idea, how long it will continue this trend? Since all know huge backlog making impossible to assess anything.
2. What next? filing I-485? and I-846 support letter? anything else?
3. How long this procedure will take in typical case?
4. While applying for Citizenship, did my legal authorized stay in USA count? or zero counter begins?
5. How do I get work authorization for my son in University? or for my wife, now stay home? Available any alternates?

Hi,
I applied for SSN for my wife using the EAD,the person at the SSN office noticed that the date of birth on the EAD was not correct, but still took the application.Our lawyer reapplied for a new EAD last week but we recieved the SSN, please let me know if my wife can work using the SSN or wait till the reapplied EAD is approved.

I am currently on L1 individual extension in US.
I will be traveling to India shortly for 2 week vacation. I will be attending the visa interview for stamping at Chennai before my return to US.
Can someone tell me/share what are the chances of visa getting stamped? What kind of questions to expect?
I hope that since i am already on extension in US, visa stamping is just a formality at US embassy?
Please let me know ASAP.

Guys, Assuming that everyone from July Filers group went through FP for AOS once at that time, do they need to go again to get the AOS approved now? My question is ppl who r being approved these days and if they r july filers, did they go for 2nd FP? Can uscis use FP of EAD in 485 ?

I am on H1-B. I filed I-485, I-131 and I-765 in August 2007 under EB3 (ROW). I got married in Sept 2007 but my wife is still in home country due to J-1 2 year HRR. Her 2 years are up in Jan 15, 2008 and she plans to join me on H4.
1. Does my company or I need to do anything for her to apply for a visa at the consulate? Does she take a copy of my H1-B approval marriage certificate and that's it?
2. When she comes the US at the end of January we plan on filing I-485 for her based on my application pending. Can she file for AP and EAD at the same time? Would she be able to work on EAD if it gets approved?
3. I got a letter in the mail today that I have to appear for biometrics on Nov 07, 2007. Does it mean that after my biometrics are taken my GC could get approved right away, even though EB3-ROW is no longer current?
4. After my I-485 has been pending for 180 days, does it mean I could take a similar job anywhere?
