I understand that we will need to specify the date and duration in the applicaiton for AP to travel to INDIA. I am planning to go end of this year but not 100% sure and date is also not finalized.
I have following question:
1. If I mention some date in AP but could not travel around that date. Would that cause any problems?
2. What I stayed longer or shorter than specified peroid in AP? Will that cuase any issue when return to USA?
Please help me. Thank you.

I think yes you can as far as you have valid copy of your I-140 approval new employer can start the process and you can port the priority date.

I have filed an appeal for a rejected I 140, which is I 290B.
I also filed a new I 140 using the same labor (EB3, august 2003)
Now I am seeing constant changes to LUDs to both status online, but the text doesnt change.
I 290B had LUD change for 3 days, and I 140 had LUD change for 3 days too.
I am confused now... does this mean they are working on the case?
constant changes like these furstrate me when there is no message or text change in status.
Can the gurus here predict according to similar trends? what can I expect?

Folks,
I hope someone can help me out here. Here's my situation -- I am EB2 with PD of May 24th 2006 (current date is May 8th 2006).
I applied for my I-485 September 2008 and have had EAD for more than a year now. However, I got married in Feb 2009 (after my 485 application) and never had a chance to add my wife to the application (she's on H4).
Now, I really really want to change my job (not change of role/title, just change of company).
How does it work if I change companies now? I don't want to or rather can't use EAD since that will make my wife's status invalid. Now, if I am to get a H1B transfer, what happens with my GC application given I already have my EAD with the current company??
Please advise. Thank you!

I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.
As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).
Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

I have applied for OPT application (applied first time) in second week of May @ Vermont Service Center.
In last week of June, my employer filed H1B visa via premium processing and it gets approved within a week. H1B start date is Dec 1, 2010.
Last week, I received RFE for my OPT application stating that my status has changed to H1B. Please provide approval receipt. I have sent the approval receipt to USCIS. Current online status of OPT application shows that USCIS office received requested documents and my case is pending.
1. Will it affect my OPT application?
2. My original joining date is already postponed by 2 weeks. Still I am waiting for OPT card. Should I request expedite processing of my OPT application? or should I wait?
Please let me know. Thanks.

My PERM was filed during July 2008 and got audited. I've got my H1B 7th year extension up to Dec 2010 (including recapture time). Now what will happen if my PERM is denied say on March 2010?
Should I leave the country immediately on March 2010 or Can I stay in US till H1B validity i.e. Dec 2010?
Any inputs would be appreciated.
